Appeal Court throws out Amaechi’s case against Governor Wike
Former Rivers State governor and current Transport Minister, Rotimi Amaechi has yet again suffered defeat at the Appeal Court as the court on Monday sacked his appeal challenging the constitution of a judicial panel of inquiry by Governor Nyesom Wike to probe him.
Amaechi had gone to the Port Harcourt division of the appellant court to challenge the state government’s judicial panel of inquiry set up to probe the sale of some of the state’s assets by the immediate past administration led by the minister.
Amaechi in his appeal, among other things, challenged the setting up of the panel and his invitation to the Justice George Omereji-led panel of inquiry.
His appeal came following a judgement by Justice Simeon Amadi of the Rivers State High Court that dismissed the suit challenging the right of the panel to probe his administration.
When the case with suit number CA/PH/342/2015, came up on Monday, the presiding judge, Justice O. F. Omoloye, sacked all the pleas of the ex-governor, except one, which bordered on whether he (Amaechi) had the locus standi to institute a legal action against the constitution of the judicial commission of inquiry.
Delivering his judgment, Justice Omoleye held that the state governor had the right to set up a commission of inquiry to investigate the sale of assets belonging to the state.
